Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the ONUS ID applications and services provided by ONUS ID ("we," "our," or "us"). These Terms apply to the following applications:

• ONUS ID — A mobile application (iOS and Android) that allows consumers to enroll biometric credentials and view their verification history across participating stores.
• ONUS Age Verification — An iPad application used by retail store staff to verify customer age using biometric identity verification, ID document scanning, or date-of-birth entry.
• ONUS Merchant — A desktop application for macOS and Windows that serves as a companion to the ONUS Age Verification iPad app, enabling a two-device verification workflow for retail environments.
• ONUS Dashboard — A web-based admin panel for managing stores, users, devices, and compliance across your entire operation.

By downloading, installing, or using any ONUS ID application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

2. Eligibility

You must be at least 18 years of age to create an ONUS ID account or use any ONUS ID application. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are using ONUS Age Verification, ONUS Merchant, or ONUS Dashboard on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Account Registration & Security

3.1 ONUS ID Users (Consumers)

• You must complete enrollment and facial recognition setup before your account is fully activated.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information during registration.
• You must notify us immediately of any unauthorized access to your account.

3.2 Store Staff & Merchant Users

• Store accounts are created by ONUS ID administrators and provisioned with login credentials.
• You must not share your login credentials with any other person.
• You are responsible for all activity that occurs under your account.

4. Biometric Data Consent

4.1 What Biometric Data Is Collected

• Facial recognition data for identity verification and age verification
• These biometric identifiers are collected solely for the purpose of identity verification and age verification at retail locations.

4.2 How Biometric Data Is Processed

• Facial recognition processing occurs on-device during enrollment and verification.
• ONUS ID does not store raw biometric data (facial images or templates) on its servers.
• Only verification results (success/failure) and metadata (timestamp, store location, method) are retained.
• Facial recognition includes verification safeguards to ensure accurate identity matching.

4.3 Data Retention

• Verification records are retained for compliance and audit purposes for three (3) years from your last verification.
• No raw biometric images or facial templates are stored on ONUS ID servers.
• Under the Illinois Biometric Information Privacy Act (BIPA), verification records are destroyed within three (3) years of your last interaction with the service.
• You may request deletion of your account and all associated data at any time by contacting us at support@onusid.com.

ONUS Merchant	Operating as a desktop companion to the ONUS Age Verification app within authorized retail locations
ONUS Dashboard	Managing stores, users, devices, and compliance for authorized businesses

6. Prohibited Conduct

You agree NOT to:

• Provide false, misleading, or fraudulent information during registration or verification
• Attempt to impersonate another person or use another person's biometric data
• Attempt to circumvent, disable, or interfere with any security features of the applications
• Use the applications for any unlawful purpose or in violation of any applicable laws
• Reverse-engineer, decompile, or disassemble any part of the applications
• Share, transfer, or sell your account or login credentials to any third party
• Use automated systems, bots, or scripts to access the applications
• Attempt to access data or systems that you are not authorized to access

Violation of these prohibitions may result in immediate account termination and may subject you to legal liability.

7. Third-Party Services

ONUS ID applications integrate with third-party services, including but not limited to:

• Wink (Payfave Inc.) — Provides biometric enrollment, identity verification, and liveness detection services. Your use of biometric features is subject to Wink's Terms of Service and Privacy Policy.

We are not responsible for the practices, policies, or content of third-party services. We encourage you to review the terms and privacy policies of any third-party services you interact with through our applications.

8. Intellectual Property

All content, features, functionality, software, designs, trademarks, and service marks associated with ONUS ID applications are owned by ONUS MS or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use our applications for their intended purposes, subject to these Terms.

You may not copy, modify, distribute, sell, or lease any part of our applications without our prior written consent.

9. Device & Data Communication

9.1 Local Device Communication

ONUS Age Verification and ONUS Merchant communicate with each other over local network connections (Wi-Fi and/or Bluetooth LE). This communication is:

• Encrypted end-to-end using AES-256-GCM encryption
• Authenticated via PIN-based pairing with ECDH key exchange
• Confined to the local network — no verification data is transmitted over the internet during the device-to-device verification process

9.2 Backend Communication

ONUS ID applications communicate with our backend servers via HTTPS for:

• User authentication and session management
• Submitting verification results (metadata only — no biometric data)
• Retrieving verification history
• Device registration

10. Account Termination

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms
• Your account is associated with fraudulent or suspicious activity
• The store or merchant you are associated with is disabled or terminated
• Required by law or legal process

Upon termination, your right to use the applications ceases immediately. You may request deletion of your account and associated data by contacting us at support@onusid.com.

11. Disclaimers

We do not warrant that:

• The applications will be uninterrupted, error-free, or secure
• Biometric verification will be 100% accurate in all conditions
• The applications will meet all of your requirements
• Any defects will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONUS MS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATIONS.

Our total aggregate liability for any claims arising from or related to these Terms or the applications shall not exceed one hundred U.S. dollars ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless ONUS MS, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the applications
• Your violation of these Terms
• Your violation of any applicable law or third-party rights
• Any fraudulent or unauthorized use of your account

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, unless you opt out within 30 days of accepting these Terms by contacting support@onusid.com.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the applications or by email. Your continued use of the applications after such changes constitutes your acceptance of the updated Terms.
